Municipal approval vs HOA architectural guidelines
The recent judgment handed down by the Wester Cape High Court on 18 August 2026 in Baronetcy Estate Homeowners Association v Mohamed Abdulahi raises several important questions for homeowners associations and their members.
These include whether municipal approval overrides an HOA’s architectural requirements, when penalties become excessive or unenforceable, and whether architectural rules may lawfully impose restrictions beyond those contained in the applicable municipal planning scheme.
Over the coming weeks, we will examine these issues in a three-part series, considering both the court’s findings and their broader practical implications for homeowners associations.
The first article is “Municipal approval is not a free pass”. Keep an eye on your inbox over the next two Wednesdays, when we will publish the remaining two articles dealing with HOA penalties and the validity of architectural rules. Stay tuned.
