Even though disputes are a very normal part of community scheme living, many bodies corporate do not have a prescribed procedure in place to deal with complaints effectively and legally. In addition, many people who are involved with sectional title schemes are not aware that the Sectional Titles Schemes Management Act actually includes an annexure that can make the process of dealing with complaints much more formalised and fair.
In Auren's article for November 2021, he discusses Annexure 4 of the SMSTA, the Prescribed Complaint Form, and suggests a complaints procedure that can be included in your scheme's conduct rules.
