Important notice to sectional title schemes: City of Cape Town tariff ruling

Trustees and managing agents should take note of a significant recent judgment of the Western Cape High Court concerning the City of Cape Town’s 2025 tariff structure.

The Court has declared the City’s fixed water, fixed sanitation and city-wide cleaning charges, each calculated with reference to property value rather than actual consumption, unlawful and invalid, with the order taking effect from 30 June 2026.

This has direct budgeting implications for community schemes.

Many sectional title schemes moved quickly last year to incorporate these additional municipal charges into their budgets. In a number of cases, this resulted in material increases in levies, which in turn caused understandable dissatisfaction among owners, particularly where the charges were not linked to actual usage.

The judgment now makes it clear that these charges will fall away from 30 June 2026 and trustees and managing agents should therefore take this into account when preparing upcoming budgets.

Upcoming Workshop - Mastering the CSOS Dispute Resolution Process

On 29 June, from 9 - 11 am, Auren will be hosting a 2-hour workshop with the University of Cape Town's Law@Work Professional Development Project, titled Mastering the CSOS Dispute Resolution Process.

The workshop will aim to assist those involved in community schemes with effectively drafting and defending CSOS applications, navigating the conciliation and adjudication processes with confidence and appealing or enforcing adjudication orders. With the recent updates to the CSOS dispute resolution process, this workshop will be valuable to many stakeholders in the community scheme industry.
