Taking a closer look at CSOS's 2025 Practice Directives
On Friday, 18 July, CSOS released their 2025 Consolidated Practice Directives, which was developed to supersede all previous directives on the subjects contained within.
Upon closer inspection of this document, it is clear that sections of the directive blatantly ignore precedents set by the courts, notably with regard to the application of the POPI Act / PAIA to members' rights to access scheme documentation.
Auren tackles this subject in more detail in his article, so click across using the links below to read his thoughts on the directive and what our response should be as community scheme stakeholders.
However, in more positive news, Ané's article highlights that CSOS does seem to have taken some feedback from the industry into account in the sections dealing with undesirable rules, where certain rules that were included within the draft version of the document have been changed or replaced. While there are still some "undesirable rules" that do not make total sense when read in line with the STSMA, there has at least been some progress made in this area. You can get her full take on "undesirable rules" in the article link below.
